  12. BACKSLASH LICENSE STATEMENT
  13. AND LIMITED WARRANTY
  14.  
  15. IMPORTANT - READ CAREFULLY
  16. This license statement and limited warranty constitutes a 
  17. legal agreement ("License Agreement") between you (either as 
  18. an individual or a single entity) and Backslash for the
  19. software product ("Software") identified above, including
  20. any software, media, and accompanying on-line or printed
  21. documentation.
  22.  
  23. BY INSTALLING, COPYING, OR OTHERWISE USING THE
  24. SOFTWARE, YOU AGREE TO BE BOUND BY ALL OF THE TERMS
  25. AND CONDITIONS OF THE LICENSE AGREEMENT.
  26.  
  27. Upon your acceptance of the terms and conditions of the 
  28. License Agreement, Backslash grants you the right to use the 
  29. Software in the manner provided below. If you do not agree
  30. to be bound by any or all of the terms of this Agreement,
  31. Backslash is unwilling to grant you any rights to use the
  32. Software and you must not use the Software; instead you
  33. must promptly remove the Software from your computer.
  34.  
  35. This Software is and shall remain a proprietary product
  36. owned by Backslash and is protected by copyright law and
  37. international copyright treaty. Therefore, you must treat
  38. this Software like any other copyrighted material (e.g., a
  39. book), except that you may either make one copy of the
  40. Software solely for backup or archival purposes or transfer
  41. the Software to a single hard disk provided you keep the
  42. original solely for backup or archival purposes. Backslash
  43. shall retain ownership of all patents, copyrights,
  44. trademarks, trade names, trade secrets and other
  45. proprietary rights relating to or residing in the Software.
  46. Except for the license grant provided, you shall have no
  47. right, title or interest in or to the Software. The
  48. Software is licensed, not sold, to you for use only under
  49. the terms of this Agreement.

  51. If you have received an upgrade version of the Software, it 
  52. constitutes a single product with the Backslash software
  53. that you upgraded. You may use or transfer the upgrade
  54. version of the Software only in accordance with the License 
  55. Agreement. 
  56.  
  57. The Software may NOT be distributed via any means without
  58. prior written agreement from Backslash.
  59. Backslash grants to you as an individual, a personal, 
  60. nonexclusive license to install and use the Software for the 
  61. sole purpose of finding the status of domain names. You may 
  62. install a copy of the Software on a computer and freely move 
  63. the Software from one computer to another, provided that you 
  64. are the only individual using the Software.
  65. You may transfer the Software and documentation on a
  66. permanent basis provided you retain no copies and the
  67. recipient agrees to the terms of the License Agreement.
  68. Except as provided in the License Agreement, you may not
  69. transfer, rent, lease, lend, copy, modify, translate,
  70. sublicense, time-share or electronically transmit or receive
  71. the Software, media or documentation. You agree not to
  72. modify the Software or attempt to reverse engineer,
  73. decompile, or disassemble the Software, except and only to
  74. the extent that such activity is expressly permitted by
  75. applicable law notwithstanding this limitation.

  77. LIMITED WARRANTY
  78. Backslash warrants that the Software, as updated and when
  79. properly used, will perform substantially in accordance
  80. with the accompanying documentation, and the Software media
  81. will be free from defects in materials and workmanship, for
  82. a period of ninety (90) days from the date of receipt.  Any
  83. implied warranties on the Software are limited to ninety
  84. (90) days. Some states/jurisdictions do not allow
  85. limitations on duration of an implied warranty, so the
  86. above limitation may not apply to you.

  88. Backslash does not guarantee the accuracy of any of the
  89. search results produced by the Software. The status of
  90. a particular domain name should be confirmed with an
  91. appropriate domain name registrar.
  92.  
  93. Backslash's and its suppliers' entire liability and your 
  94. exclusive remedy shall be, at Backslash's option, either
  95. (a) return of the price paid, or (b) repair or replacement
  96. of the Software that does not meet Backslash's Limited
  97. Warranty and which is returned to Backslash with a copy of
  98. your receipt. DO NOT RETURN ANY PRODUCT UNTIL YOU
  99. HAVE OBTAINED A RETURN AUTHORIZATION NUMBER
  100. FROM BACKSLASH.
  101. This Limited Warranty is void if failure of the Software
  102. has resulted from accident, abuse, or misapplication.
  103. Any replacement Software will be warranted for the
  104. remainder of the original warranty period or thirty (30)
  105. days, whichever is longer. Neither these remedies nor any
  106. product support services offered by Backslash are
  107. available without proof of purchase.
  108.  
  109. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW,
  110. BACKSLASH DISCLAIM ALL OTHER WARRANTIES AND
  111. CONDITIONS, EITHER EXPRESS OR IMPLIED, INCLUDING,
  112. BUT NOT LIMITED TO, IMPLIED WARRANTIES OF
  113. MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE,
  114. TITLE, AND NON-INFRINGEMENT, WITH REGARD TO THE
  115. SOFTWARE, AND THE PROVISION OF OR FAILURE TO
  116. PROVIDE SUPPORT SERVICES. THIS LIMITED WARRANTY
  117. GIVES YOU SPECIFIC LEGAL RIGHTS. YOU MAY HAVE
  118. OTHERS, WHICH VARY FROM STATE/TERRITORY TO
  119. STATE/TERRITORY.
  120.  
  121. LIMITATION OF LIABILITY
  122. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW,
  123. IN NO EVENT SHALL BACKSLASH BE LIABLE FOR ANY SPECIAL,
  124. INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES
  125. WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR
  126. LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS
  127. OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS)
  128. ARISING OUT OF THE USE OF OR INABILITY TO USE THE
  129. SOFTWARE PRODUCT OR THE PROVISION OF OR FAILURE TO
  130. PROVIDE SUPPORT SERVICES, EVEN IF BACKSLASH HAS BEEN
  131. ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN ANY
  132. CASE, BACKSLASH'S ENTIRE LIABILITY UNDER ANY PROVISION
  133. OF THIS LICENSE AGREEMENT SHALL BE LIMITED TO THE
  134. GREATER OF THE AMOUNT ACTUALLY PAID BY YOU FOR THE
  135. SOFTWARE PRODUCT OR U.S. $25; PROVIDED, HOWEVER, IF
  136. YOU HAVE ENTERED INTO A BACKSLASH SUPPORT SERVICES
  137. AGREEMENT, BACKSLASH'S ENTIRE LIABILITY REGARDING
  138. SUPPORT SERVICES SHALL BE GOVERNED BY THE TERMS OF
  139. THAT AGREEMENT. BECAUSE SOME STATES AND TERRITORIES
  140. MAY NOT ALLOW THE EXCLUSION OR LIMITATION OF
  141. LIABILITY, THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

  143. HIGH RISK ACTIVITIES
  144. The Software is not fault-tolerant and is not designed, 
  145. manufactured or intended for use or resale as on-line 
  146. control equipment in hazardous environments requiring fail-
  147. safe performance, such as in the operation of nuclear 
  148. facilities, aircraft navigation or communication systems, 
  149. air traffic control, direct life support machines, or 
  150. weapons systems, in which the failure of the Software could 
  151. lead directly to death, personal injury, or severe physical 
  152. or environmental damage ("High Risk Activities"). Backslash 
  153. specifically disclaim any express or implied warranty of
  154. fitness for High Risk Activities.
  155.  
  156. TERMINATION
  157. You may terminate this Agreement at any time. This Agreement
  158. shall terminate automatically upon your breach of any term
  159. of this Agreement. Upon termination, you shall destroy the
  160. Software and the backup copy, if any, you made pursuant to
  161. the Agreement. All other sections of this license shall
  162. survive any termination of this Agreement.

  164. GENERAL PROVISIONS
  165. This License Agreement may only be modified in writing 
  166. signed by you and an authorized officer of Backslash. All 
  167. terms of any purchase order or other ordering document shall 
  168. be superseded by this License Agreement. If any provision 
  169. of the License Agreement is found void or unenforceable, the 
  170. remainder will remain valid and enforceable according to its 
  171. terms. If any remedy provided is determined to have failed 
  172. for its essential purpose, all limitations of liability and 
  173. exclusions of damages set forth in this License Agreement 
  174. shall remain in effect.
  175.  
  176. This License Agreement shall be construed, interpreted and 
  177. governed by the laws of the State of Victoria, Australia.  
  178. This License Agreement gives you specific legal rights; you 
  179. may have others which vary from state to state and from 
  180. country to country. Backslash reserves all rights not 
  181. specifically granted in this License Agreement.
